Data privacy policy

1. general information in brief

The following information provides a simple overview of what happens to personal data when our website is visited. Personal data is any data by which someone can be personally identified. Detailed information on the subject of data protection can be found in the privacy policy listed below this text.

Who is responsible for data collection by PHONOGEN.COM?

Data processing on this website is carried out by the website operator. This contact information is listed below or can be found in the imprint of this website.

How do we collect data?

Data is collected on the one hand by communicating it to us. This can be, for example, data that is entered into a contact form. Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. Internet browser, operating system or time of page view). The collection of this data takes place automatically as soon as our website is entered.

What do we use the data for?

Some of the data is collected to ensure error-free provision of the website. Other data may be used to analyze user behavior.

What rights does the user have regarding data?

The user has the right to receive information free of charge at any time about the origin, recipient and purpose of his stored personal data. He also has the right to demand the correction, blocking or deletion of this data. For this purpose, as well as for further questions on the subject of data protection, the user can contact us at any time at the address given in the imprint. Furthermore, he has the right to complain to the competent supervisory authority.

Do we analyze data?

When visiting PHONOGEN.COM, the user's surfing behavior may be statistically analyzed. This is done primarily with cookies and with so-called analysis programs. The analysis of the surfing behavior is usually anonymous; the surfing behavior cannot be traced back to the user. The user can object to this analysis or prevent it by not using certain tools. If the user does not want cookies to be stored on his computer, he is asked to deactivate the corresponding option in the system settings of his browser. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies can lead to functional restrictions of this online offer.

 2. notes and obligatory information

PHONOGEN.COM takes the protection of personal data very seriously. We treat personal data confidentially and in accordance with the legal data protection regulations and this privacy policy. When the user uses PHONOGEN.COM, various personal data are collected. Personal data is data with which the user can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done. We point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

Who is responsible for the data?

Rino F. Meyer
PHONOGEN.COM
Breitingerstrasse 31
8002 Zuerich
Phone: 0041 79 404 30 44
E-Mail: info@phonogen.com

What data do we process?

- Inventory data (name, adresse)
- Contact data (e-Mail, phone no.)
- Content data (text fields, photos, videos(-links)
- Usage data  (web pages visited, access times)
- Metada (device information, IP-adresses)

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses or similar).

How can the user revoke consent?

Many data processing operations are only possible with the express consent of the user. Consent that has already been given can be revoked at any time. For this purpose, an informal communication by E-Mail to us is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Where can the user complain?

In the event of violations of data protection law, the person concerned has a right of complaint. The competent supervisory authority for data protection issues can be found here.

Does the user have the right to data portability?

The user has the right to have data that PHONOGEN.COM processes automatically on the basis of the user's consent or in fulfillment of a contract handed over to him/herself or to a third party in a common, machine-readable format. If the user requests the direct transfer of the data to another responsible party, this will only be done to the extent that it is technically feasible.

Do we use SSL/TLS encryption?

PHONOGEN.COM uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that the user sends to us as the site operator. An encrypted connection can be recognized by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol of the browser line.

If SSL or TLS encryption is activated, the data that the user transmits to us cannot be read by third parties.

Is the payment transaction encrypted?

If, after the conclusion of a contract with costs, there is an obligation for the user to provide us with his payment data (e.g. credit card number), this data is required for payment processing.

Payment transactions via the common means of payment (Stripe.com) are made exclusively via an encrypted SSL or TLS connection. An encrypted connection can be recognized by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol of the browser line.

With encrypted communication, payment data that the user transmits to us cannot be read by third parties.

Can the user request information, blocking or deletion?

Within the framework of the applicable legal provisions, the user has the right at any time to free information about his stored personal data, their origin and recipient and the purpose of data processing and, if necessary, a right to correction, blocking or deletion of this data. For this purpose, the user can contact the following e-mail at any time: info@phonogen.com

3. cookies

PHONOGEN.COM sometimes uses so-called cookies. Cookies" are small files that are stored on users' computers. Cookies serve to make our offer more user-friendly, more effective and safer. Different information can be stored within the cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after his visit within an online offer.

Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online offer and closes his browser. These are the cookies we use most often. Other cookies remain stored on the terminal device until they are deleted by the user. These cookies allow us to recognize the user's browser on the next visit.

A browser can be set to inform the user about the setting of cookies, to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of the PHONOGEN website may be limited.

Cookies that are required to carry out the electronic communication process or to provide certain functions desired by users (e.g. shopping cart function) are stored on the basis of Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g. cookies for the analysis of a user's surfing behavior) are stored, these are treated separately in this privacy policy.

A general objection to the use of cookies used for online marketing purposes can be declared for a large number of the services, especially in the case of tracking, via the U.S. site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/ erklärt werden.

Which server log files do we transmit?

The provider of PHONOGEN.COM automatically collects and stores information in so-called server log files, which the user's browser automatically transmits to us. These are:

- browser type and browser version
- used operation systems
- referrer URL
- Host name of the accessing computer
- Time of the server request
- IP adresse

This data is not merged with other data sources.

The basis for data processing is Art. 6 para. 1 lit. f DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

What happens to the data when I fill out the contact form?

If the user sends us inquiries via the contact form, the information provided by the user in the inquiry form, including the contact data provided by the user, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without the user's consent.

The processing of the data entered in the contact form is therefore based exclusively on the consent of the user (Art. 6 para. 1 lit. a DSGVO). The user can revoke this consent at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data entered by the user in the contact form will remain with us until he requests us to delete it, revokes his consent to store it, or the purpose for storing the data no longer applies (e.g. after the request has been processed). Mandatory legal provisions such as e.g. retention periods remain unaffected.

What happens to the login data?

The user can register on PHONOGEN.COM to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which the user has registered. The mandatory information requested during registration must be provided in full. Otherwise the registration will be rejected.

For important changes, for example in the offer or for technically necessary changes, we use the e-mail address provided during registration to inform the user in this way.

The processing of the data entered during registration is based on the consent of the user (Art. 6 para. 1 lit. a DSGVO). The user can revoke his consent at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing already carried out remains unaffected by the revocation.

The data collected during registration will be stored by us as long as the user is registered on our website and will then be deleted. Legal retention periods remain unaffected.

What happens to customer data from contracts (Lifetime-Licence)?

We collect, process and use personal data only to the extent that they are necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 (1) lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process and use personal data about the use of our websites (usage data) only to the extent necessary to enable the user to use the service or to bill the user.

The collected customer data will not be deleted after completion of the order or deactivation of the customer account (termination of the business relationship) due to the lifetime license. Legal retention periods remain unaffected.

What happens with data of third parties?

We transmit personal data to third parties only if this is necessary for the processing of the contract, for example to the credit institution (Stripe.com) commissioned with the processing of payments.

A further transmission of data does not take place or only if the user has expressly consented to the transmission. Data will not be passed on to third parties without express consent, for example for advertising purposes.

The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

4. analysis tools and advertising

Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

The storage of Google Analytics cookies is based on Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its web offering and its advertising.

IP anonymization
We have activated the IP anonymization function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by the user's browser as part of Google Analytics will not be merged with other Google data.

Browser Plugin
The user may refuse the use of cookies by selecting the appropriate settings on the browser, however please note that if you do this you may not be able to use the full functionality of this website. In addition, the user can prevent/disable the collection of the data generated by the cookie and related to his use of the website (including the user's IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en

Objection to data collection
The useer can prevent the collection of his data by Google Analytics by clicking on the following link. An opt-out cookie will be set that prevents the collection of his data during future visits to this website: https://tools.google.com/dlpage/gaoptout?hl=en

Objection to advertising mails
The use of contact data published within the framework of the imprint obligation for sending advertising and information material not expressly requested is hereby objected to. The operators of PHONOGEN.COM expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.

Commissioned data processing
We have concluded a contract with Google for commissioned data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic characteristics with Google Analytics
This website uses the "demographic characteristics" function of Google Analytics. This allows reports to be generated that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google as well as visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in the user Google account or download and install the collection of this data by Google Analytics with the following link available browser plugin: https://tools.google.com/dlpage/gaoptout?hl=en

The user can find more information on how Google Analytics handles user data in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=en

Google Analytics Remarketing
Our websites use the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. In this way, interest-based, personalized advertising messages that have been adapted to the user's previous usage and surfing behavior on one end device (e.g. cell phone) can also be displayed on another end device (e.g. tablet or PC) of the user.

If the user has given corresponding consent, Google links a web and app browsing history with the user's Google account for this purpose. In this way, the same personalized advertising messages can be displayed on every device on which the user logs in with his Google account.

To support this feature, Google Analytics collects Google-authenticated IDs of users, which are temporarily linked to our Google Analytics data to define and create target groups for cross-device ad advertising.

The user can permanently object to cross-device remarketing/targeting by deactivating personalized advertising in their Google account; to do so, please follow this link: https://www.google.com/settings/ads/onweb/

The aggregation of the collected data in the user's Google account is based exclusively on the user's consent, which the user can give or revoke at Google (Art. 6 para. 1 lit. a DSGVO). In the case of data collection processes that are not merged in his Google account (e.g. because the user does not have a Google account or has objected to the merging), the collection of data is based on Art. 6 (1) lit. f DSGVO. The legitimate interest results from the fact that the website operator has an interest in the anonymized analysis of website visitors for advertising purposes.

The user can find further information and the data protection provisions in Google's data protection declaration at: https://www.google.com/policies/technologies/ads/

Google AdWords and Google Conversion-Tracking
This website uses Google AdWords. AdWords is an online advertising program of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").

Within the framework of Google AdWords, we use the so-called conversion tracking. When the user clicks on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that the Internet browser stores on the user's computer. These cookies lose their validity after 30 days and are not used to personally identify the user. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that the user clicked on the ad and was redirected to this page.

Each Google AdWords customer receives a different cookie. The cookies cannot be tracked across AdWords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. The customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, the user does not receive any information that can be used to personally identify them. If the user does not wish to participate in the tracking, he can object to this use by easily deactivating the Google conversion tracking cookie via his internet browser under user settings. He will then not be included in the conversion tracking statistics.

The storage of "conversion cookies" is based on Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

The user can find more information about Google AdWords and Google conversion tracking in Google's privacy policy: https://www.google.de/policies/privacy/

The user can set his browser so that he is informed about the setting of cookies, which allows cookies only in individual cases, excludes the acceptance of cookies for certain cases or generally and activates the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Facebook Tracking Pixel
Within the user's consent, we use the "visitor action pixel" of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") within our website. With its help, we can track the actions of users after they have seen or clicked on a Facebook ad. This allows us to track the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, which means that we do not see the personal data of individual users. However, this data is stored and processed by Facebook, about which we inform the user according to our level of knowledge. Facebook may link this data to the user's Facebook account and also use it for its own advertising purposes, in accordance with Facebook's Data Use Policy https://www.facebook.com/about/privacy/. The user may allow Facebook and its partners to serve ads on and off Facebook. Furthermore, a cookie may be stored on the user's computer for these purposes. This consent may only be given by users older than 13 years of age. If the user is younger, we ask that he or she ask his or her legal guardians for advice. In this case, we ask to contact us by mail if the consent would like to be revoked: info@phonogen.com

5. newsletter

We send newsletters by e-mail with useful information about the world of music and for the purpose of promotional information about our products (ProTraxx). For this we need an e-mail address, name/first name and country of the user. The registration is done with the double opt-in method and after subscribing to the newsletter the user will receive an e-mail asking for confirmation. The confirmation is necessary so that we can verify that the user is the owner of the specified email address and thus agrees to receive the newsletter.

The processing of the data entered in the newsletter registration form is based exclusively on the consent of the user (Art. 6 para. 1 lit. a DSGVO). The consent given for the storage of the data, the e-mail address as well as their use for sending the newsletter can be revoked at any time, for example via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The registration for the newsletter is recorded by log in order to make the registration process traceable. The time of registration and confirmation as well as the IP address are recorded. The user's changes to the data stored with the dispatch service provider are also logged. This enables us to provide a user-friendly and secure newsletter system that serves both our business interests and the expectations of users and allows proof of consent. No further data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The data provided by the user for the purpose of receiving the newsletter will be stored by us until the user unsubscribes from the newsletter and will be deleted after the user unsubscribes from the newsletter. Data stored by us for other purposes (e.g. e-mail addresses for the member area in the customer account) remain unaffected by this.

Web beacons" are pixel-sized files that are retrieved by our dispatch service provider when the newsletter is opened. These are: Browser information, IP address and time of retrieval. This information is used to improve the service based on technical data, reading behavior of the target group, retrieval locations (determinable with the help of the IP address) or access times. In addition, statistics are collected on whether and when a newsletter is opened and on which links are clicked. This information is related to the newsletter recipient for technical reasons. However, there is no intention either by us or by the dispatch service provider to observe individual users when sending the newsletter. Rather, the evaluation serves to recognize the reading habits of the newsletter recipients and to adapt our content to the user or to send different interests of the user accordingly.

The performance measurement is based on the consent of the recipients according to Art. 6 para. 1 lit. a, Art. 7 DSGVO in conjunction with § 7 para. 2 No. 3 UWG or on the basis of the legal permission according to § 7 para. 3 UWG.

Mail Chimp
The newsletter is sent in cooperation with the mailing service platform "MailChimp" (Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA). The privacy policy of the shipping service provider can be viewed here: https://mailchimp.com/legal/privacy/. The Rocket Science Group LLC (MailChimp) is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection. The data of the newsletter recipients can be used by the shipping service provider (MailChimp) in pseudonymous form without assignment to a user to optimize the service, but not to write to the newsletter recipients themselves or to pass the data on to third parties.

6. integration of third-party services and control

Unless otherwise stated in our privacy policy, we process the data of users if they communicate with us within the social networks and platforms, e.g. write posts on our online presences or send us messages.

We use within our online offer on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) to integrate content or services offered by third-party providers, such as videos or fonts (hereinafter referred to as "content").

This always requires that the third-party providers of this content, perceive the IP address of users, because without the IP address they could not send the content to their browser. The IP address is thus required for the display of this content. We endeavor to use only such content whose respective providers use the IP address only for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer, as well as be combined with such information from other sources.

YouTube
Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. When the user visits one of our pages equipped with a YouTube plugin, a connection to the YouTube servers is established. In the process, the YouTube server is informed which of our pages the user has visited. If the user is logged into his YouTube account, he enables YouTube to assign his surfing behavior directly to his personal profile. This can be prevented by the user logging out of his YouTube account. YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. For further information on the handling of user data, the user can refer to YouTube's privacy policy at: https://www.google.de/intl/de/policies/privacy

Google Web Fonts
This site uses so-called web fonts provided by Google for the uniform display of fonts. When a page is called up, the user's browser loads the required web fonts into its browser cache in order to display texts and fonts correctly. For this purpose, the browser used by the user must connect to Google's servers. This enables Google to know that our website has been accessed via the user's IP address. Google Web Fonts are used in the interest of a uniform and appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. If the user's browser does not support web fonts, a standard font is used by his computer. The user can find further information on Google Web Fonts at https://developers.google.com/fonts/faq and in Google's privacy policy: https://www.google.com/policies/privacy/

Facebook
Within our online offer, functions and contents of the service Facebook may be integrated, offered by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. This may include, for example, content such as images, videos or texts and buttons with which users can make known their liking regarding the content, the authors of the content or subscribe to our posts. If the users are members of the Facebook platform, Facebook can assign the call of the above-mentioned content and functions to the profiles of the users there. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as the related rights and settings options for protecting the privacy of users, can be found in the privacy policy of Facebook: https://www.facebook.com/about/privacy/

Instagram
Within our online offer, functions and contents of the service Instagram may be integrated, offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. This may include, for example, content such as images, videos or texts and buttons with which users can make known their liking regarding the content, the authors of the content or subscribe to our posts. If the users are members of the Instagram platform, Instagram can assign the call of the above-mentioned content and functions to the profiles of the users there. Further information on Instagram and its privacy policy can be found by the user at: http://instagram.com/about/legal/privacy/

Soundcloud
Within our online offer, functions and content of the service Soundcloud may be integrated, offered by Soundcloud. Plugins of the social network SoundCloud (SoundCloud Limited, Berners House, 47-48 Berners Street, London W1T 3NF, United Kingdom.) may be integrated on this website. The user recognizes the SoundCloud plugins by the SoundCloud logo on the affected pages. When the user visits PHONOGEN.COM, a direct connection is established between the user's browser and the SoundCloud server after the plugin is activated. SoundCloud thereby receives the information that the user has visited our site with his IP address. If the user clicks the "Like" or "Share" button while logged into his SoundCloud user account, the content of our pages can link to his SoundCloud profile and/or share. This allows SoundCloud to associate the user's account with the visit to PHONOGEN.COM. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by SoundCloud. For more information, the user can refer to the privacy policy of SoundCloud at: https://soundcloud.com/pages/privacy

7. payment service provider

We work together with an online payment service provider. During the ordering process for the payment of our products and services (ProTraxx), the user's contact details are transmitted to the payment service provider as part of the completed order. The payment service provider acts in the capacity of a trustee. The provider of this payment service is Stripe, 185 Berry Street, Suite 550, San Francisco, CA 94107. The transmission of data to Stripe is based on Art. 6 (1) a DSGVO (consent) and Art. 6 (1) b DSGVO (processing for the performance of a contract). The user has the option to revoke his consent to data processing at any time. A revocation does not affect the validity of past data processing operations.

The personal data we forward to Stripe include: First name, last name, address, phone number, IP address, email address and other data that exists in connection with the order (item number, number of items, invoice and tax amount, info on the invoice ect.).

Without this information, we can not carry out any order processing in our online store. These personal data are therefore necessary, in particular the identity of the user for the administration of his payment. This data may also be disclosed to subcontractors or other companies in a business relationship, insofar as this is necessary to fulfill the contractual obligations arising from the order or the data must be processed on behalf.

We assume that Stripe carries out credit checks in relation to the User's order. Which data is collected, processed, stored and passed on by Stripe can be viewed in the privacy policy of Stripe under the following link: https://stripe.com/us/privacy.
